Welcome to modelpolas.com ("the Website," "the Platform," "we," "us," or "our"). By accessing or using modelpolas.com, registering an account, uploading media, or contacting models through our service, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.

1. Description of Service

modelpolas.com provides a specialized platform where models can create public profiles, showcase current and historical sets of natural, unedited photos ("Polaroids" or "Polas"), update physical measurements, and showcase relevant skills and links. The Platform also allows third parties (such as agencies, scouts, brands, and clients) to discover, filter, and contact models directly.

2. Account Registration and Access

  • Eligibility: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register a Model profile on modelpolas.com. If you are under 18, you may only register with explicit legal guardian authorization and oversight where permitted by local law.
  • Passwordless Authentication: We use a Magic Link authentication mechanism. You are responsible for maintaining the security of your email account used to log in. Any action performed via a Magic Link sent to your email address is deemed to be performed by you.
  • Custom Profile URLs: Models choose a unique custom URL handle (e.g., modelpolas.com/your-handle). We reserve the right to reclaim, remove, or modify handles that infringe on trademarks, impersonate public figures, or violate these Terms. Changing your handle will alter your profile URL and break existing external links; we are not responsible for broken links or lost traffic resulting from handle changes.

3. User Content & Polaroid Upload Rules

  • Ownership: You retain all ownership rights to the photographs, videos, measurements, and text ("User Content") you upload to modelpolas.com.
  • License Grant: By uploading content, you grant modelpolas.com a worldwide, non-exclusive, royalty-free, sublicisable license to display, host, store, crop, automatically watermark, and optimize (e.g., resize up to 2048px and convert to WebP/JPG) your content solely for the purpose of operating, promoting, and maintaining the Platform.
  • Content Restrictions:
    • Polaroid photo sets must consist of natural, minimal/no-makeup, unretouched, or lightly edited photographs intended for modeling identification.
    • You may not upload content that contains illegal material, non-consensual imagery, hate speech, severe violence, or copyright-infringing media.
    • Uploading promotional ads, spam, or non-modeling portfolios in place of Polas is prohibited.
  • Moderation: All uploaded Polaroid sets default to a pending state and are subject to review by our moderation team. We reserve the right to approve, reject, hide, or permanently remove any Polaroid set or media that fails to meet our quality guidelines or violates these Terms.

4. Identity Verification & Paid Services

  • Stripe Identity Verification: Models may choose to purchase a "Verified Badge" to confirm their identity. The verification process is facilitated via Stripe Checkout and Stripe Identity (requiring a valid government-issued ID/Passport and live facial match).
  • Non-Refundable Fee: The verification fee covers the administrative and processing costs of the automated KYC verification check via Stripe. Payment of the verification fee does not guarantee a successful verification status if the submitted ID or facial check is rejected by Stripe Identity. Verification fees are non-refundable once the verification session has been initiated.
  • Accuracy: You warrant that all identification documents provided during verification are authentic, valid, and belong to you. Submitting fraudulent identification will result in an immediate and permanent ban without refund.

5. Contact System & Public Interaction

  • Communication: Visitors and potential clients may send messages to registered models using the Platform’s integrated contact form. The Platform relays these inquiries to the email address associated with the model's account without publicly exposing the model's email address.
  • No Agency Relationship: modelpolas.com is an open web index and platform provider, not a talent agency, booking agency, or representative. We do not negotiate contracts, guarantee employment, handle model payments/bookings, or act as an agent. Any agreement or employment resulting from contact made via modelpolas.com is strictly between the model and the hiring party.
  • Safety & Conduct: Users must not send spam, harassment, inappropriate requests, or unsolicited commercial offers unrelated to modeling opportunities through the contact system.

6. Prohibited Conduct

When using modelpolas.com, you agree not to:

  1. Use automated scripts, bots, scrapers, or crawlers to extract profile data, measurements, or photographs from the Platform.
  2. Impersonate any person, model, agency, or entity.
  3. Attempt to bypass authentication, reverse-engineer, or disrupt the operation of the Platform.
  4. Upload photographs or media for which you do not hold the necessary rights or photographer permissions.

7. Disclaimers and Limitation of Liability

  • "As-Is" Service: modelpolas.com is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
  • Third-Party Interactions: We do not conduct background checks on non-registered visitors or clients who contact models via the Platform. Models are solely responsible for verifying the legitimacy and safety of any casting, client, or job offer received.
  • Limitation of Liability: To the maximum extent permitted by applicable law, modelpolas.com, its operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or reputation resulting from:
    • Your use or inability to use the Platform.
    • Unauthorized access to or alteration of your profile or content.
    • Conduct or communications of third parties met through the Platform.

8. Termination and Account Deletion

You may request the deletion of your account and profile data at any time through your account settings or by contacting support. We reserve the right to suspend or terminate accounts, remove profiles, or revoke access to the Platform at our sole discretion, with or without notice, for conduct that violates these Terms.

9. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to modelpolas.com with an updated "Last Updated" date. Continued use of the Platform after changes are published constitutes your acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to modelpolas.com shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of Barcelona, Spain.
